Welcome to Wello. These Terms of Service ("Terms") govern your access to and use of the Wello mobile application ("App"), website, and services (collectively, the "Services"). Please read these Terms carefully before using our Services.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

Frequently Asked Questions

I've been "logged out" and cannot get back into my account

If you're experiencing issues where no verification codes are sending and the "Continue with..." buttons aren't working, this is typically due to network connectivity issues.

Solution: Try exiting the app completely, switching to mobile data temporarily, and then reopening the app. This often resolves network-related authentication issues.

I see a black (or white) screen when opening the app

This issue is almost always related to network connectivity problems. The app may be unable to load properly due to poor or no internet connection.

Solution: Try switching to mobile data, completely closing the app, and then reopening it. If the issue persists, please contact our support team with the email or phone number you used to create your Wello account.

1. Account Registration

To use certain features of our Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2. User Content and Privacy

Our Services allow you to post, link, store, share, and otherwise make available certain information, text, graphics, or other material ("User Content"). We understand and respect that this content is private and personal.

Private Content: All journal entries, pledges, and personal content shared through our platform will remain private and will not be publicly displayed, distributed, or used in our marketing materials without your explicit consent.

Community Content: Content you choose to share in community features may be visible to other Wello users, as indicated at the time of posting.

Limited License: You grant us the technical license necessary to operate the Services, including storing, backing up, and transmitting your content. This license allows us to provide, maintain, and improve our Services.

3. Data Usage

Wello is designed as a private space for your recovery journey. We collect and process certain data to provide, maintain, and improve our Services.

4. Use of the Services

Eligibility

You must be at least 18 years old and the age of legal majority in your place of residence to use the Services. By using the Services, you represent and warrant that you meet this requirement.

Your Responsibilities

You may use the Services only for lawful purposes. You may not use the Services in any manner that could damage, disable, overburden, or impair Wello's servers or networks, or interfere with any other party's use and enjoyment of the Services.

You may not attempt to gain unauthorized access to the Services, other users' accounts, or Wello's computer systems or networks through hacking, password mining, or any other means.

Without limiting the foregoing, you agree not to do, and not to encourage or allow any third party to do, any of the following:

  • Copy, modify, adapt, translate, reverse engineer, decode, or otherwise attempt to derive or gain access to any portion of the Services or Wello content
  • Use any robot, spider, site search or retrieval application, or other automated device, process, or means to access, retrieve, scrape, or index any portion of the Services
  • Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Services (or any feature or functionality) to any third party
  • Reformat or frame any portion of web pages that are part of the Services
  • Create more than one account by automated means or under false or fraudulent pretenses
  • Use the Services in any way that violates applicable federal, state, local, or international law or regulation
  • Transmit, or procure the sending of, advertising or promotional material, including junk mail, chain letters, spam, or similar solicitation
  • Impersonate or attempt to impersonate Wello, a Wello employee, another user, or any other person or entity
  • Harass, abuse, or harm other members of the community

You are solely responsible for any and all charges, fees, and other costs related to your use of the Services.

If you access and use the Services on a smartphone, tablet, or other mobile device, you must have wireless service through Wi-Fi or a participating mobile service provider.

5. Intellectual Property

Our Services and their original content (excluding User Content), features, and functionality are and will remain the exclusive property of Wello and its licensors. Our Services are protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Wello.

6. Subscription and Payments

Some aspects of our Services may be provided for a fee. If you elect to use premium features, you agree to pay all applicable fees as described on our Services.

Subscriptions will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage your subscription and turn off auto-renewal by going to your account settings after purchase.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

7. App Updates

Wello may, from time to time and in its sole discretion, develop and provide updates for the app, including upgrades, bug fixes, patches, other error corrections, and new features (collectively, "Updates").

Updates may modify or remove certain features and functionality. You agree that Wello has no obligation to provide any Updates or to continue providing or enabling any particular feature or functionality.

Based on your mobile device settings, when your device is connected to the internet, Updates may either download and install automatically or you may receive notice of, or be prompted to download and install, available Updates.

You agree to promptly download and install all Updates. If you do not, portions of the Services may not operate properly. All Updates are deemed part of the Services and are subject to these Terms.

8. Apple Devices and App Store Terms

This section applies only to the iOS version of the app used on Apple devices. These Terms are between you and Wello, not Apple Inc. Apple is not responsible for the app or its content, including claims related to intellectual property infringement, product liability, or legal compliance.

To the maximum extent permitted by law, Apple provides no warranty for the app and has no obligation to provide support. Any claims relating to the app should be directed to Wello, not Apple.

Your use of the app must comply with the App Store terms and you may only use the app on Apple devices that you own or control, as permitted by those terms.

If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price paid for the app to the extent required under applicable law. Apple is a third-party beneficiary of these Terms and may enforce applicable provisions against you.

9. Consent to Share Consumption Data with Apple

By using the app and making in-app purchases through Apple, you consent to our sharing usage and consumption data relating to purchased content with Apple when needed to review or resolve refund requests.

This may include information about how purchased content was accessed or used. We share this information only as necessary for refund processing and in accordance with Apple's policies.

10. Termination

We may terminate or suspend your account and bar access to our Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

If you wish to terminate your account, you may simply discontinue using our Services or contact us to request account deletion.

11. Limitation of Liability

In no event shall Wello, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use our Services; (ii) any conduct or content of any third party on our Services; (iii) any content obtained from our Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

12. Disclaimer

Your use of our Services is at your sole risk. Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. Our Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Not a Medical Device

The Services, including recovery- or health-related information, are provided for informational purposes only. Wello does not warrant or guarantee any treatment, therapy, medication, diagnosis, action, recommendation, or strategy that may be referenced through the Services.

We cannot answer medical questions through the app, email, or any other support channel.

Wello is not a substitute for professional medical advice, diagnosis, or treatment. Do not disregard, avoid, or delay obtaining medical advice from a qualified healthcare provider because of something you read through the Services.

Do not use the Services for emergency medical needs. If you believe you are experiencing a medical emergency, contact a qualified healthcare professional and call your local emergency services immediately (911 in the United States).

Wello does not warrant that: a) our Services will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) our Services are free of viruses or other harmful components; or d) the results of using our Services will meet your requirements.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
